On March 27th, a federal jury ordered Monsanto to pay a California man $80 million in damages after determining the company was liable for causing the man to develop non-Hodgkin’s lymphoma. The jury ruled that Monsanto did not provide adequate warnings about the health risks of using its popular weed killer, Roundup®.

The plaintiff claimed he used Roundup® on his property for over two decades, often getting the weed killer on his hands and face. He was diagnosed with cancer in 2015.
Bayer stated that years of research has shown that glyphosate, the active ingredient in Roundup®, is safe, and the company acted responsibly in manufacturing and distributing its product.
However, the plaintiff’s lawyers argued that the herbicide has been shown to cause cell mutations that can lead to the development of cancer in humans. In 2016, the World Health Organization designated glyphosate a probable carcinogen.
Previous Decisions Against Monsanto
Earlier this month, the same six-person jury decided that glyphosate was a “substantial factor” in causing the plaintiff to develop cancer.
Wednesday’s decision marks the second legal defeat for Monsanto in less than a year. In August 2018, a separate state jury awarded another California man $289 million, determining Monsanto failed to provide warnings about Roundup®’s cancer risks. A judge later reduced the payout amount to $78 million.
Over 11,000 similar claims are waiting to go to trial in state and federal courts across the U.S. The judgments in the present two cases are likely to have an impact on future claims.
